1. SUBJECT AND SCOPE

These terms and conditions apply to the use of this website at www.ohmygift.co.uk (the “Website”) and relations between the Website and any person buying Products from it. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions. Ohmygift.co.uk reserves the right, at any time, to modify these terms and conditions.
Using this Website indicates that you fully accept these Terms and Conditions regardless of whether or not you choose to register with us or order from us. If you do not accept these terms, do not use this website.

2. ORDERS

By confirming that you have read and agree to be bound by our Terms and Conditions, you are making an offer to purchase the Product(s), which you have specified in your shopping basket. All orders are subject to acceptance by The Website. You will receive a confirmation of your order by email, along with your order reference number. This number should be retained for future reference. Any acceptance of your order by the Website is subject to these Terms and Conditions and to the availability of stock.

The Website reserves the right to withdraw any Products from the Website Shop and may, in its sole discretion, refuse to process an order for any reason at any time. Without prejudice to your statutory rights as a consumer, the Website will not be liable to you or a third party by reason of the Website withdrawing any Product or refusing to process any order.

The order will be consider as valid only after the reception by the Buyer of the Website order confirmation and the collection of its whole amount.
The website reserves the right to interrupt any order for any reason at any time. In that case, The Website will inform the Buyers as soon as possible.

3. PRODUCT AVAILABILITIES

Whilst the Website makes every effort to deliver goods on the day we specify on each Product page, we cannot guarantee delivery on that day or accept liability for deliveries made outside this timescale. This also applies to products sent direct from our manufacturers. The Website shall have no liability to you for any delay or failure to deliver the Products to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of the Website (Force Majeure) including, but not limited to, fire, floods, acts of God, acts or regulations of any governmental or supranational authority, war, riot, strike, lock-out and industrial disputes.

4. PRICES AND PAYMENT

All prices are quoted in £ Sterling.
All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.
They do not include the delivery charges, which are charged in addition to Products prices according to the amount of the whole order. The appropriate rates are set out on each Product page.

The Website reserves the right to change prices and delivery charges at any time. Except in the case of manifest error, the prices payable for Products that you order are as set out on the Website at the time at which you place your order.

5. DELIVERY COSTS

Delivery charges include preparation and packing charges as well as postage. The appropriate rates are set out on each Product page.

They differ according to each Product and the amount or weight of these products and may add up if an order is processed by multiple Ohmygift.co.uk providers.
The Website offers a very large range and a great variety of personalized products. A majority of these products, requiring specific equipment and skill, is prepared and sent directly by craftsmen and manufacturers partners of the Website.
Some postal addresses in Northern Ireland, some offshore islands and some remote areas of Great Britain may not be covered by our normal delivery services and so we may have to contact you to advise you of extra postal charges.
The delivery charges are of course set at cost-price. In order to minimize those charges the Website limits them to £15. Any charge above this amount is covered by the Website.

6. METHODS OF PAYMENT

The Buyer confirms that he owns the right the necessary authorisations to use the method of payment he would have chosen during the purchase order recording.

Payment may be made:

1. Using a wide selection of credit and debit cards (please refer to our Payment Method section in the Help Desk). You confirm that the credit/debit card which is being used is yours. Your credit/debit card details will be transmitted via the web to a secure server. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. Signature Gifts Limited reserves the right to refuse credit card payments in its reasonable discretion.

2. By cheque following an order made on the Website. Only cheques make out in Pounds (£) and drawn by a bank in the United Kingdom will be accepted. Please do not forget to write your order number behind the cheque, draw it to the account of Ohmygift.co.uk and send it to OhMyGift.co.uk, 26 Bloomsbury Street, WC1B 3QJ, London W1F 7, United Kingdom. The Website will not process your order until its bank credits its account with your remittance. The Website may ask for a copy of the Buyer’s identity card or may refuse a payment. If the Website does not receive the cheque within ten days, the order will be cancelled.

The Website will not process your order until its bank credits its account with your remittance. If the Website does not receive the transfer within ten days, the order will be cancelled.

7. DELIVERY

We will deliver the Products ordered by you to the address which you give for delivery when you make your order. If any of the details you have given us in your delivery address are incorrect, we are not liable for any items which have not been received.

We do not deliver outside of the UK.

The Product property transfer becomes effective from its exit from our stores. Therefore the buyer accepts all risks, in particular the transport risks. The Buyer should plan the necessary precautions before planning the delivery. The Website reserves the right to organise the Products transport as best as it can, without any liability.

8. ORDER CANCELLATIONS

The Website Products are deemed brand new and flawless However the Buyer has the legal right to cancel and your order within 7 working days of receiving the Products for an exchange or a refund. Order cancellations must be made in writing, quoting your order number, within 7 working days beginning the day after the day on which the item is delivered. The Website will then communicate the return address. The Buyer has to return the Products to us. The costs of returning goods to us shall be borne by the Buyer. Only the Products in perfect resale condition, in their original condition (packaging, accessories, instruction manual…), sealed, will be taken into account. The item is the Buyer responsibility until it reaches us. For your own protection, we recommend that you send the parcel back to using a delivery service that insures you for the value of the goods as we cannot be held responsible for items damaged or lost in the post. However, this does not apply to Products which we have made, personalised or customised specifically for you. It does not apply to perishable goods, audio or video recordings or computer software which has been opened. Please note: In order to provide a fast service some products are immediately sent for production. Please check your order on screen and the confirmation email carefully as we cannot refund products which have been mis-spelt.

9. PROPRETY AND RISK TRANSFERS

. Ohmygift.co.uk retains the property of the sold Products until full payment of their prices. The Website reserves the right to reclaim the ordered Products in case of nonpayment or payment default, with the costs of returning goods borne by the Buyer. The loss and deterioration risks transfer is effective as soon as the Product is transmitted to the transporter. Once the Products received, during the cancellation period mentioned above, the Buyer is responsible for the Products he ordered. In case of deterioration or destruction of the Products during this period, The Buyer won’t be able to claim an exchange or a refund to the website.

10. DATA PROTECTION

Ohmygift.co.uk respects the most restrictive privacy protection standards and only uses the users’ information collected for the commercial operations of its Website.

Any Website user is legally entitled to receive, upon payment of a fee, a copy of any personal information about him (email address, address, phone number…) which it holds and require the rectification, erasure or blocking of any of your personal information which is inaccurate or not up to date held by the Website.

Please note that Ohmygift.co.uk Privacy Policy liability does not extend to third party sites (partners, advertisers…) to which we may provide links within the Website.

11. TERRITORIALITY AND GOVERNING LAW

These Terms and Conditions shall be exclusively governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

12. LIABILITY

Ohmygift.co.uk Users should take into account the technical hazards related to the Internet network, preventing the Website to ensure its uninterrupted working and its associated services. The Website liability cannot include any unavailability or malfunctioning, in particular in case of breakdown, maintenance or updates. The same way, the Website cannot guarantee the usage of the online service on all web-browsers, computer equipment and software set-ups. Ohmygift.co.uk shall have no liability to you for any delay, failure to deliver, Product shortage or unavailability, to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of the Website (Force Majeure) including, but not limited to, fire, floods, acts of God, acts or regulations of any governmental or supranational authority, war, riot, strike, lock-out and industrial disputes. Ohmygift.co.uk shall not in any event be liable to the Buyer for any direct or indirect damage which may arise from purchasing its Products, any direct loss in excess of the payment amount or any loss of profits, business or anticipated savings or loss of or corruption to data or any other indirect loss or consequential loss whatsoever even if it has been advised of the possibility of such loss. Ohmygift.co.uk shall not in any event be liable to the Buyer for the content of websites linked to his by hypertext links.

13. BUYER’S ACCEPTANCE

These Terms and Conditions as well as the price list are explicitly admitted and accepted by the Buyer, who asserts and recognises having a perfect knowledge of them. Hence, the Buyer abandons the right to claim any contradictory document, and in particular his own terms and conditions, the purchase action leading to the acceptance of these Terms and Conditions.

How can I gain Clovers?
> By ordering on Ohmygift.co.uk

For every £10 spent on orders (delivery costs excluded), you are awarded 1 Clover, or that is, £0.50 in discount voucher. On each product page is specified the number of Clovers associated.
If the order is canceled, the Clovers awarded on this order will be debited off the client account. If those Clovers have already been used on a new purchase, their amount will have to be reimbursed to Ohmygift.co.uk.

Sponsor a friend and you will be awarded 8 Clovers, or that is, £4 in discount voucher. Your friend will benefit from a 6-Clover credit, or that is, £3 in discount voucher available for its first purchase on Ohmygift.co.uk

> By filling up our satisfaction survey

Fill up the satisfaction survey you will receive a few days after receipt of your order and you will be awarded 3 Clovers, or that is, £1.50 in discount voucher.
For example: If you buy a £45 personalised necklace, fill up the survey and sponsor a friend, you will awarded 3 Clovers through your purchase, 3 through the survey and 8 through the sponsorship. A total of 14 Clovers, or £7 in discount voucher for your next purchase on Ohmygift.co.uk!

How do I use the awarded Clovers?

You can know how many Clovers you have when you access your account.
They can be used at your convenience on your next purchase on Ohmygifft.co.uk and are valid for 6 months as from the acquisition date of your last Clover.
Clovers do not apply to delivery costs and may not be combined with any other form of promotion.

Sponsorship Conditions

8 Clovers are awarded to Ohmygift.co.uk clients initiating a first order made by their sponsored friend.
The sponsored friend, during his registration as site member, has the possibility to indicate his sponsor’s e-mail address before completing his first purchase.
The sponsorship is subject to the following conditions:
> The sponsor must be a member of Ohmygift.co.uk and must have ready purchase a product on the website.
> The sponsored friend has never purchase anything on Ohmygift.co.uk
> The sponsored friend has no other sponsor
> The sponsored friend does not live at the sponsor‘s address and has a different e-mail address
If these conditions are satisfied, the sponsored friend obtains after his registration 6 Clovers available for his first order. As soon as this order is completed and paid, the sponsor is awarded 8 Clovers.
The order cancellation would lead to the withdrawal of the sponsor’s awarded Clovers.
The “auto-sponsorship” consisting in a client registering with different e-mail addresses in order to create false sponsorships is prohibited.

The awarded Clovers are not available to other members.
In case of serious irregularities by a Clover Loyalty Program member, Ohmygift.co.uk will take any necessary measures in order to stop those irregularities and will thus cancel the advantages and other discounts that may have been awarded to the member.
Those conditions are applicable starting June 1st 2010 and can be changed at any time by Ohmygift.co.uk.
